About these terms

FizziLabs provides Activity Calendar subject to these terms and applicable law. "FizziLabs," "we," and "us" refer to the service's operator. Review these terms before using the service. If you disagree, do not use it.

The Privacy Policy describes local storage, file processing, hosting requests, and support correspondence.

Scope of the service

Activity Calendar extracts and displays dates from supported files and lets you edit work, demand, PTO, and holiday dates. Files are processed on your device. Only extracted dates are retained from imports; source files and unrelated contents are not uploaded or kept by the application.

The service is a planning aid, not a system of record or a deadline-verification service. It does not provide legal, financial, medical, or other professional advice, send appointment reminders, or monitor deadlines. Use does not create a professional-client, agency, or fiduciary relationship. County-map descriptors are reference information from identified publishers, not predictions of litigation outcomes.

Your responsibility for dates and data

You are responsible for checking every important date against its original source before relying on it. This includes completeness, date order, years, time-zone context, duplicates, conflicts, and any filing, contractual, employment, or other deadline. Do not rely on this tool alone for a deadline, appointment, or other consequential decision.

Numeric dates use month/day order. Dates without years use the calendar's stored default year. Extraction cannot determine whether every date-like string is relevant to your task.

Keep independent backups and your original files. Calendar data is saved locally with encryption when browser saving is available. Your browser also holds the key for automatic reopening. Browser cleanup, damaged storage, unavailable browser features, or lost keys can destroy access to your data. We have no recovery copy and undertake no duty to recover or reconstruct it. Use a device and browser profile you trust.

Permitted use and misuse

You may use the tool for lawful personal or business planning with information you are authorized to use. You must not use it to violate another person's rights, distribute malicious code, disrupt availability, bypass access or security controls, or impose an unreasonable automated load on the service.

We may restrict or terminate access to protect the service or respond to misuse or legal requirements. No permission is granted to use the FizziLabs name or branding in a way that implies our endorsement.

No warranties or service commitment

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We disclaim express and implied warranties, including merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. We do not warrant error-free extraction, uninterrupted availability, compatibility with every file or browser, security against every threat, or permanent retention of your data.

We may change, suspend, or discontinue this free service. No support, maintenance, recovery, or service-level commitment is made unless separately agreed in writing. External publishers and service providers control their own information and availability.

Exclusion of damages

TO THE FULLEST EXTENT PERMITTED BY LAW, FIZZILABS, ITS OPERATOR, AND ITS CONTRIBUTORS DISCLAIM LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE SERVICE. This includes lost profits, business interruption, lost opportunities, lost data, and missed appointments or deadlines to the extent those losses fall within these categories. The exclusion applies regardless of the legal theory, including contract or ordinary negligence, even if the possibility of the damage was disclosed.

Required limits: These terms do not exclude or limit responsibility for fraud, willful injury, gross negligence, violations of law, or liability and remedies that cannot lawfully be waived. Mandatory consumer and privacy rights, regulator access, and public injunctive relief remain protected.

Third-party claims caused by misuse

To the extent permitted by law, you agree to indemnify and hold harmless FizziLabs, its operator, and its contributors from third-party claims, liabilities, damages, and reasonable defense costs caused by your unlawful use of the service, violation of another person's rights, or intentional breach of these terms. This obligation does not cover any portion caused by our negligence, misconduct, or violation of law.

For a claim within that obligation, we may request that you provide a defense with reasonably acceptable counsel. We will give reasonable notice and cooperate with that defense. You may not settle a covered claim in a way that imposes an obligation, admission, or restriction on us without our written consent. This section does not waive a right that the law makes non-waivable.

Applicable law and disputes

California law and applicable federal law govern, subject to mandatory protections that apply where you live. Disputes may be brought in California courts with jurisdiction to the extent legally permissible. You may contact [email protected] to seek resolution. Nothing requires you to surrender a legally guaranteed venue or remedy.

If a provision is unenforceable, the remaining terms continue to the extent permitted by law. Failure to enforce a provision is not a waiver of the right to enforce it later. These terms are the complete terms for this service unless we separately agree otherwise in writing.

Updates and contact

Revisions will be posted here with a new date and apply prospectively. We will provide notice of material changes and obtain any additional agreement required by law before relying on those changes.
